1. Risk Warning to participants

1.1 Miles Away Limited, trading as Packrafting Queenstown (Packrafting Queenstown) provides packrafting courses, guided packrafting trips, and packraft rentals (Packrafting Activities). Participating in any of these Packrafting Activities in any capacity can be harmful.

1.2 Packrafting Queenstown warns participants that participation in Packrafting Activities involves a general risk of harm that may result in loss or damage to participants including personal injury or death.

1.3 The sources of the risk of harm include (but are not limited to):

1. impacts from equipment, poor, wet or slippery surfaces, physical exertion, intentional or accidental contact or collisions with objects or other participants;


2. disparity in experience or condition of participants;


3. acts or omissions by Packrafting Queenstown or its agents and employees or others involved in the organisation or running of Packrafting Activities;


4. damage or loss to personal property as a result of participation in Packrafting Activities;


5. faulty or damaged equipment;


6. food or food preparation;


7. weather conditions;


8. insect bites;


9. road traffic accidents;


10. river conditions such as depth, temperature, current strength and velocity;


11. activity leading to drowning;


12. activity leading to hypothermia;


13. activity leading to muscular-skeletal injuries,


14. obstacles in, overhanging or near to water such as rocks, trees, debris, other packrafts, packrafting equipment, animals and people; and


15. inadequate facilities for treatment or transport in the event of injury.

1.4 You participate in Packrafting Activities at your own risk. If you do not want to be exposed to such risks, then you should not participate in Packrafting Activities.

1.5 By signing below, you acknowledge, agree, and understand that participation in Packrafting Activities may involve risk. You agree and undertake any such risk voluntarily.

2. No Warranty

2.1 Packrafting Queenstown makes no warranties in respect of any services to be provided in connection with the Packrafting Activities referred to in this notice and to the extent permitted by law any such implied warranties are expressly excluded.

3. Privately Owned Land

3.1 The Packrafting Activities may take place on privately owned land. Owners of privately owned land (Landowners) do not have any influence, control or decision-making power in respect of the Packrafting Activities or any aspect of health and safety associated with the Packrafting Activities.

4. Participant Acknowledgment

4.1 The participant acknowledges and agrees that he or she:

1. is physically fit and able to participate in the relevant Packrafting Activity;


2. has no medical condition that may adversely affect his or her participation in the Packrafting Activity;


3. chooses to participate in the Packrafting Activity voluntarily;


4. understands the risks associated with the Packrafting Activity;


5. will comply with all reasonable safety instructions, directions, signs, procedures and the health and safety management systems of Packrafting Queenstown.


6. will not participate in any aspect of the Packrafting Activity when impaired by drugs or alcohol, including when travelling to or from the Packrafting Activity; and


7. will take all reasonably practicable steps to ensure his or her own health and safety and the health and safety of others (taking into account the inherent risks associated with the Packrafting Activity).

4.2 The participant also acknowledges that he or she:

1. understands to the extent permissible by law Landowners are not liable for any breach of health and safety laws, policies, or guidelines that may arise as a result of the Packrafting Activities;


2. will not pursue any claim or other action against a private landowner in the event of injury, physical or mental, death, damage to property, or other form of loss, to themselves or others in relation to the Packrafting Activity on that landowner’s private land;


3. understands to the extent permissible by law Packrafting Queenstown and its employees, suppliers, associated companies, representatives and other associated parties are not liable for any breach of health and safety laws, policies, or guidelines that may arise as a result of the Packrafting Activities; and


4. will not pursue any claim or other action against Packrafting Queenstown and its employees, suppliers, associated companies, representatives and other associated parties in the event of injury, physical or mental, death, damage to property, or other form of loss, to themselves or others in relation to the Packrafting Activity.
